The Ombudsman considered the calculation of final pensionable salary by reference to three years average pensionable salary. The Ombudsman considered that the definition of "Final Pensionable Salary" was ambiguous and that on the facts he had to decide what the correct interpretation of the provision was. He noted that two sets of administrators had calculated it differently. The Ombudsman decided that the correct construction meant "Final Pensionable Salary" should be based on the highest average of three consecutive annual pensionable salary figures without apportionment for part years.
