Sally Clark is Of Counsel in the Dispute Resolution Team and practises primarily in the CMS Corporate Crime Group.

Sally specialises in advising clients in corporate and financial crime matters, with particular expertise in fraud, bribery and corruption, money laundering and civil recovery matters.

Sally joined CMS from the Crown Office and Procurator Fiscal Service (“COPFS”) where her experience included the preparation of a number of high-profile large and complex financial crime cases.  She is able to use her hands-on experience of dealing with a broad range of allegations of corporate crimes, including bribery and corruption, money laundering, insider dealing, financial assistance, cartel offences and health and safety offences, to guide clients on the investigation and prosecution of such matters in Scotland. 

Relevant experience

  • Advising clients on suspicions of bribery and other financial crime, potential corporate liability arising from such allegations and requirements to notify in terms of the Scottish self-report scheme.
  • Anti-money laundering compliance and procedures, including requirements to submit suspicious activity reports and liaison with the NCA about the same.
  • Defending prosecutions raised by Companies House for failure to comply with directors’ Companies Act duties.
  • Challenging financial penalties imposed by the Home Office in context of Border Force powers,
  • Guiding client through investigation by local authority into regulatory offences, including at attendance at interview under caution with an office holder.
  • Advising on criminal procedure and investigatory powers for law enforcement, including bail, procedural timescales, post-conviction procedure and scope for compensation award.
  • Managing investigation into sanctions breaches in respect of funds subject of an account freezing order.
  • Delivering training to clients on all aspects of financial crime, including new failure to prevent fraud offence, corporate liability for acts of senior managers, bribery and corruption, money laundering, sanctions.
  • Drafting and reviewing clients’ financial crime policies and procedures.
  • Advising client on criminal allegations arising from betting on date of general election.
