AI regulation in your jurisdiction
EU legislation is in force. The following national laws implement the EU AI Act
- Act LXXV of 2025 on the Implementation in Hungary of the European Union Regulation on Artificial Intelligence
- Government Decree 344/2025 (31.X.) on the Implementation of Act LXXV of 2025 on the Implementation in Hungary of the European Union Regulation on Artificial Intelligence
The national rules do not contain any specific deviation from the EU AI Act: it is only designating authorities and members of national AI board equivalents, and defining minor administrative law related provisions (converting fine maximum to Hungarian currency, content of reports etc.).
Existing Regulatory Frameworks Applicable to AI
Other relevant laws that govern AI-related activities are:
Fundamental rights:
- The Fundamental Law of Hungary (English version available here) is relevant for the protection of fundamental rights and for the AI Act implementation.
- Act XXVI of 1998 on the rights of disabled persons and ensuring their equality
- Act XVII of 2022 on the general rules on compliance with accessibility requirements regarding products and services implements EU Accessibility Act
Civil law issues, liability, contracts:
- Act V of 2013 on the Civil Code (English version available here) on the fundamental rules of private law (such as liability, obligations, contracts or representation)
- Act CLV of 1997 on Consumer Protection (English version available here) which also applies to AI deployers and providers providing AI to consumers
- Act LXXXVIII of 2012 on market surveillance of products contains product safety provisions also applies to product with AI components
Criminal law and liability:
- Act C of 2012 on the Criminal Code (English version available here) on criminal conducts related to the use of AI (such as Information system fraud; Illegal data acquisition).
- Act XXXIV of 1994 on Police (unofficial English translation available here), Act CLXXXVIII of 2015 on the facial image analysis register and the facial image analysis system: defining law enforcement powers in relation to using surveillance and face recognition.
Data protection:
- Act CXII of 2011 on the right to informational self-determination and on the freedom of information (English version available here) implements the EU GDPR and governs personal data processing and interacts closely with automated decision-making and AI deployments.
AI Office, administrative procedures:
- Act CL of 2016 on the Code of General Administrative Procedure (English version available) lays down the basic rules according to which the Hungarian administrative bodies (including the Hungarian AI Office) are bound in their procedures.
- Act CXXXIX of 2013 on the Hungarian Central Bank (unofficial English translation available here) designating the Central Bank as a market surveillance authority for financial institutions using high-risk AI systems.
Cybersecurity, operational resilience:
- Act LXIX of 2024 on the Cybersecurity of Hungary (English version available here) implementing the NIS2 directive where essential and important entities that deploy AI systems must comply with both cybersecurity requirements and AI-specific risk management frameworks.
- Act CCXXXVII of 2013 on credit institutions and financial enterprises (English version available here or here) implements EU DORA Regulation.
- Act CCXXXV of 2013 on the payment service providers (English version available here or here) and Act LXXXV of 2009 on the payment services (English version available here or here) implements EU DORA Regulation for payment service providers.
Copyright:
- Act LXXXVI of 1999 on Copyright (English version available here) plays a central role in developing jurisprudence concerning the relationship between AI and copyright and implements EU TDSM directive on data mining copyright exceptions.
Regulatory Oversight of AI
While Hungary has already adopted legislation implementing the EU AI Act, the authorities identified below have not yet established a body of practice or guidance for their activities. The relevant legislation is as follows:
- Act LXXV of 2025 on the Implementation in Hungary of the European Union Regulation on Artificial Intelligence
- Government Decree 344/2025 (31.X.) on the Implementation of Act LXXV of 2025 on the Implementation in Hungary of the European Union Regulation on Artificial Intelligence
- The National Accreditation Authority (Nemzeti Akkreditációs Hatóság) is the “notifying authority” under Article 28 of the EU AI Act.
- The Minister of Enterprise Development (vállalkozásfejlesztési miniszter) is the AI market surveillance authority under Article 70 of the EU AI Act (AI Office).
- For high-risk AI systems used by financial institutions, the Hungarian National Bank (Magyar Nemzeti Bank) serves as the market surveillance authority when the AI system is directly provides those financial services.
- The Hungarian Artificial Intelligence Council, an advisory body without decision-making powers, composed of representatives from key authorities, government bodies, academia, research institutions, and business organisations.
AI Guidance, Policies, and Strategic Frameworks
- On 3 September 2025 the Hungarian government published Hungary’s Artificial Intelligence Strategy for the 2025-2030 period.
- Hungary’s Research, Development and Innovation Strategy (2021–2030) published by the Ministry for Innovation and Technology emphasizes the need for AI related developments in research and innovation.
International AI Standards and Guidelines
Nothing specific to the Hungarian market.
Forthcoming AI Legislation
As the EU has already adopted the AI Act and Hungary passed relevant legislation for implementing the rules of the AI Act. Nothing further is expected at this moment.
