Status of the implementation of the EmpCo Directive re. Green Claims and Sustainability Labels across EU countries - track local laws and country-specific regulations

The EU’s Empowering Consumers for the Green Transition Directive (Directive (EU) 2024/825, the “EmpCo Directive”) introduces new rules on environmental claims and sustainability labels and requires Member States to transpose those rules into national law by 27 March 2026, with the new framework to apply from 27 September 2026. As several countries have not yet completed transposition, the legal position is still developing across the EU.

The CMS Implementation Tracker shows the status of transposition in the Member States, highlights any differences from the EU legislation, and notes country-specific peculiarities. It also indicates whether local authorities or other relevant bodies have issued guidance, outlines the sanctions that are relevant in each country, and provides an overview of labels proving recognized excellent environmental performance.

In that context, also the European Commission’s FAQs (European Commission) have to be noted, which offer helpful practical guidance on the new rules. Companies should therefore closely monitor national implementation measures and take legal advice where needed to understand the changing requirements and ensure their claims, labels, and compliance processes remain aligned with applicable law.
