New Electricity Sector Tariff Regulation - Regulation (ERSE) No. 2/2025

Yesterday, ERSE approved Regulation No. 2/2025 (ERSE numbering), following a public consultation process. This new Electricity Sector Tariff Regulation revokes Regulation No. 828/2023 of 28 July.

The Electricity Sector Tariff Regulation aims to update the regulatory mechanisms and methodologies in terms of permitted revenues and the tariff structure, in view of the start of a new regulatory period that will be in force from 2026 to 2029.

The main changes in Regulation No. 2/2025 are as follows:

  • Strengthening of incentive-based regulation, notably the introduction of new incentives, such as those relating to the technical performance of the overall system management and the technical performance of transmission and distribution networks, with components that encourage the allocation of network capacity in the form of restricted access.
     
  • In terms of the economic regulation of high and medium voltage transmission and distribution activities, a new revenue component has also been introduced to ensure the economic and financial balance of the respective operators in the allocation of injection capacity reserves in the network, in the form of an agreement between the interested party and the network operator.
     
  • Rules are defined for regulated activities in the business universe of the futures market manager, which are complemented by the Manual of Procedures for the Registration and Bilateral Contracting of Electricity, approved by Directive No. 8/2025.
     
  • Changes in tariffs with improvements to the mechanism for quarterly updating of energy tariffs and greater flexibility in the rules for changing between tariff options.
