Construction | A tale of two contracts

Date: Tuesday 8 March, 11.00 CET/10.00 UK

The risks that an insurer agrees to accept will not necessarily include all the consequences of a problem in the design or execution of a project. In this seminar we will explore areas of contractual and liability exposure in the construction and engineering fields which international insurance cover does not quite reach.

Speakers: Stephen Tester, Partner, CMS UK; Bas Baks, CMS The Netherlands; Bernard van den Berg, Director insurance, Royal BAM Group nv

Bonds

Date: Tuesday 22 March, 11.00 CET/10.00 UK

A large number of public and private contracts are now secured by surety bonds covering the beneficiary against a breach of contract by the bonded company. Several jurisdictions allow such bonds and they are commonplace in the construction, fuel, energy, waste, gaming, finance and other sectors.

We take a look into the use of such bonds across a number of jurisdictions including what happens when a bond is called and how bond issuers and insurers can properly safeguard their rights.

Speakers: Laura Opilio, Partner, CMS Italy; Alaina Wadsworth, Partner CMS UK; Jaime Bofill, Partner, CMS Spain; Stefan Paulmayer, Partner, CMS Austria; Cristina Popescu, S. Counsel, CMS Romania; Thomas Lockley, Partner, CMS Uk

Climate change litigation in key jurisdictions and future claims trends

Date: Wednesday 25 May, at 15.00 CET/14.00 UK

Climate related litigation is on the rise. Not only is it important to understand the drivers behind the claims being brought in different jurisdictions (in Europe, most notably Germany and Netherlands), but it is also important to identify future trends that are emerging against the backdrop of increasing regulation and legislation at local and European level.

Looking at ongoing litigation across multiple industry sectors, this webinar aims to provide insurers and their policy holders with an overview of key trends in climate-related litigation to help them avoid being the focus of scrutiny from potential claimants. In this webinar, insurance sector experts from a number of CMS offices will look at the background to the growth in climate related litigation; current active litigation in their respective jurisdictions; greenwashing; and likely future trends in this area of increased scrutiny, with a focus on the increase in legislation and regulation both at local and European level.

Speakers: Harriet Munro, Partner, CMS UK; Radcliffe Michelle, Senior Associate, CMS UK

W&I – a practical perspective on a growing product

Date: Wednesday 29 June, 11.00 CET/10.00 UK

Warranty and indemnity (W&I) insurance is on the rise. Although there are variances in coverage and forms between jurisdictions, its primary purpose is to transfer, to a third-party insurer, the risks associated with a seller's breach of warranty or liability under an indemnity in an acquisition agreement.

During this webinar our experts from multiple jurisdictions will briefly introduce W&I insurance and will touch upon some important topics relating to the W&I claims process, including:

  • How the SPA and W&I policy fit together and how the terms are to be interpreted;
  • The level of information that an insured is required to provide in order to obtain cover under a W&I policy;
  • Disclosure and the importance of this item in relation to claims under a W&I policy;
  • How different jurisdictions differ when it comes to assessing what loss an insured is entitled to following a breach of warranty.

Speakers: Virginie Frémat, Partner, CMS Belgium; Chris Bradshaw, Partner, CMS UK; Nicolò d'Elia, Partner, CMS Italy; Oskar van de Weijer, Associate, CMS
