CMS advises CIP on majority stake in H2APEX's hydrogen electrolysis project in Lubmin

Hamburg – Copenhagen Infrastructure Partners (CIP) has acquired a 70% interest in an IPCEI-funded hydrogen electrolysis project of H2APEX in Lubmin (Mecklenburg-Western Pomerania). The project is part of the IPCEI initiative ("Important Projects of Common European Interest") to promote future-oriented hydrogen technologies and comprises a planned electrolysis capacity of 100 megawatts in its first phase – with the option of additional expansion phases. CIP is one of the world's leading investment companies in the field of energy infrastructure investments and will invest approx. EUR 15 million from the current project phase until the final investment decision. The total project volume is in the region of several hundred million euros. The transaction is currently still subject to approval by the competition authorities.

A CMS team headed by lead partner Dr Holger Kraft and Dr Stefan Kühl advised CIP on all legal aspects of the transaction. CMS provided comprehensive legal advice during the negotiation of the transaction documents and advised inter alia on subsidy law and energy regulatory issues as part of the due diligence process. The CMS team led by Dr Holger Kraft is currently advising several clients in connection with IPCEI-funded hydrogen electrolysis projects.
