Environmental Impact

The imperative for climate change has led businesses to explore opportunities, address their impact on the environment and monitor relevant regulation. CMS is working with businesses across all sectors to deliver environment law advice on transactional, contentious and regulatory matters.

For over 25 years, we have led in a wide variety of transactional work where environment issues are dominant, including the cutting-edge development of contractual language.

Environment regulation is a huge element of the ESG mix. Issues are wide ranging and typical ESG environmental law considerations are outlined in the diagram below:

  • Energy efficiency

    Various private equity funds, banks, manufacturing and real estate companies, such as Columbia Threadneedle Investments, Ametek, and John Laing Infrastructure Fund, on energy efficiency, carbon and reporting obligations across the EU.

  • Clean energy

    Numerous clean energy projects, including biomass, anaerobic digestion, EfW, landfill gas, energy storage, marine, wind and solar.

  • Special Protection Areas

    Orkney Council on Scottish Government proposals to designate large areas of Orkney waters as Special Protection Areas.

  • Best Available Techniques (BAT)

    Day Group on the reversal of a rare environmental permit refusal (based on BAT) for an IBA facility.

  • Non-financial and GHG reporting

    International manufacturing with installations across the EU and elsewhere, on GHG and non-financial reporting obligations at EU and UK levels.

  • Climate related disclosures

    Advising a major international retailer on climate and carbon related laws including mandatory climate related disclosures and formal corporate reporting/ regulatory notifications in ESG in the UK, France, Iceland, Spain and Sweden.
