CMS, in partnership with YouGov, asked in-house lawyers about the biggest challenges of managing disputes in this environment - and how those challenges can be met. We asked them about project risks, ESG factors and the use of AI in managing their transactions. - Consistent sources of disputes – delays in a project, payment issues and disagreements on the scope of work are the main sources of disputes, and this is expected to be the case for the next three years.
- Out of the loop - fewer than half the businesses surveyed reported that the in-house legal or contract management team is always consulted at the start of a project to identify areas of risk and to establish appropriate risk management strategies.
- Improvement is possible - most in-house lawyers believe their businesses could improve the way in which risk is managed during projects, for example.
- ESG risks are rising – risks around sustainability reporting requirements (54%) and local labour requirements (44%) will increase over the next year.
- AI uptake is low - despite the potential benefits, only 17% of the in-house lawyers we surveyed are using AI in disputes or contract management. Some say they will never use it.
