On 26 September 2016 CMS organizes two interactive workshops on Finance Risk & Regulation with guest lecturers from CMS London.

Workshop 1: Understanding the ISDA Master Agreement and Credit Support Documentation

This refresher session on the basic ISDA derivatives documentation will be a reminder to parties of the basic framework and provisions in the ISDA Master Agreement and the pre-2016 English law credit support documentation. In this session we will cover:

  • A section-by-section analysis of the 2002 ISDA Master Agreement;
  • An overview of the pre-2016 English law credit support documentation, with a focus on the 1995 ISDA Credit Support Annex and the 1995 ISDA Credit Support Deed

This session will assume a minimal understanding of derivatives documentation and will provide a background to the later EMIR workshop for those participants who would like a refresher on the basic ISDA documentation.

Workshop 2: Understanding the new margin documentation for uncleared derivates

In this session we will cover the new margin requirements coming into force for uncleared derivatives under the European Markets Infrastructure Regulation (EMIR). This session will focus on the practical implications for market participants and what parties need to do now to comply with the new rules. This session will be most relevant to FCs (as defined in EMIR), including banks and funds. The session will cover:

  • An overview of the new margin requirements;
  • ISDA Self-Disclosure Letter;
  • New credit support documentation
  • ISDA 2016 Variation Margin Protocol

A basic understanding of derivatives documentation will be assumed.

You will have the possibility to subscribe to one or both workshops.
